摘要:
海南作为“旅游大省”、“生态大省”，生态环境的保护在其发展过程中有着关键地位，而海南作为“经济特区”，在立法上享有“立法优先权”，可以根据自身情况制定符合当地情况发展的法律法规。但目前的调研却发现，海南省近几年的生态立法远远不能达到建立生态大省、保护海南生态的需求。扩大海南生态立法范围，完善生态补偿机制，是在科学发展观指导下实现海南可持续发展的必由之路。
Abstract:
As the“tourism province” and“ecological province”, the ecological environment plays a key role in Hainan’s development. As “special economic zone”, Hainan has a “legislative priority” which let Hainan make laws and regulations according to their own circumstances. According to the recent researches, Hainan ecological legislation in recent years cannot meet the needs of establishing ecological province and protecting Hainan ecological environment. Expanding the scope of Hainan Ecological legislation and improving the ecological compensation mechanism are the only way to achieve sustainable development.
