摘要:

许多高校在意外伤害事故发生后，往往选择主动承担道德责任，这一做法对及时解决事故 问题起到了积极作用。但不能因为高校有较高的道德自律精神和较强的“给付能力”或出 于对受害人的同情，就把学校的道德责任任意扩大为法律责任，这样实际上损害了高校的 合法权益。在高校学生意外伤害事故中，学校是否应承担责任，应承担何种责任？这些问题 不仅是受伤害学生家属要求学校回答并解决的问题，而且也是各高校、高校师生以及全社 会共同关注的问题。笔者就这一问题，结合自己多年从事高校学生管理工作的经验，对大 学生意外伤害事故的涵义及归责原则进行了分析探讨。

Abstract:

After physical injury accidents of college students, colleges usually undertake moral responsibility actively and initiatively. This measure embodies colleges爷education tusk, sets up graceful moral manner, and also plays an active role in resolving accident problems in time. But colleges should not bear legal liability just because of their higher moral autonomy spirit, their stronger "paid capability冶or their sympathy to the aggrieved party. Colleges爷lawful rights and interests will have no way to get a guarantee if colleges爷moral responsibility expands into lawful responsibility. In unexpected physical injury accidents about college students, should school undertake responsibilities or not? What kind of responsibilities should colleges undertake? These problems are commonly concerned not only by relative family members, teachers and students in colleges, but also by the whole society. The author, according to the practical experience of managing students, has analyzed the conception of college students爷physical injury accident and the principles of assigning responsibility.
