摘要:: 当前要求加强物业服务行业监管的呼声此起彼伏，这不仅是行业自律的要求，也是百姓的诉求，而且许多城市已将加强物业服务行业的监管提到了政府工作的日程上来了。从监管的对象、监管的定位、监管的难点、监管的重点等几个方面入手，依据《物权法》、《物业管理条例》等法律法规，针对目前监管物业管理中出现的问题进行了分析，并提出了以下观点：监管应针对物业管理市场相关各方主体，而不应只针对物业公司；监管应维护物业管理市场交易的公平，而不是以行政意志加重企业的负担；摆脱重走政府包办的老路，创造性地走出一条通过市场机制来调节、解决市场问题的新路；依法监管，理顺、创新和建立物业管理市场制度。

Abstract:: There are continuous calls for strengthening the regulation on property management service industry, which is not only the appeal from the massive but also requirement of the self-disciplined industry. Moreover, many local governments have already had it on the schedule. The paper analyzes the problems found in the regulation of property management service against property right and property management regulation. It puts forward that the control and regulations should aim at the interested parties of property management market rather than the property management companies; the point is to guarantee the fair play in the market instead of aggravating enterprises' burden for political purpose; the government should blaze out creative ways of accommodating markets and solving the problems according to the market mechanism rather than take all roles. All in all, property management regulation system should be straightened out and improved based on laws.
